Adamawa: Ngilari Not Supposed To Be Governor- Fred Agbaje …. As Fintri Files An Appeal In Defiance Of PDP’s Position

Lagos-based Constitutional Lawyer, Fred Agbaje has picked holes in the judgment of Justice Adeniyi Ademola that ordered that Bala Ngilari be sworn in as Governor sequel to the impeachment of Murtala Nyako.
The renowned legal practitioner expressed regrets that the trial judge failed to take into cognizance the fact that the then deputy Governor actually resigned, but directed the resignation letter to the wrong person in the Speaker of the House of Assembly.
According to Agbaje, as a lawyer, Ngilari knew that the Speaker was not the person constitutionally recognized when a deputy governor is to resign. He said that Ngilari must have played on the intelligence of the Speaker who was ostensibly desperate to be governor and mounted pressure on the Nyako’s deputy to resign to pave way for him, Speaker to become Governor.
The legal luminary pointed out that it was morally wrong of Ngilari to have benefited from his wrong-doing, by misleading the people of the State through his purported resignation.
He however, took a swipe on his colleagues who collaborate with their clients to mislead the public by taking advantage of lacuna in the constitution to reap where they did not sow.
He pointed out that Ngilari who did not want to be impeached along with his former boss, did prepare two letters; one for the Governor and another for the Speaker. He said it would have been a different story if the letter had been deposited at the former Governor’s office even in his absence.
‘’ was there an intention to resign in order to avoid impeachment? He asked rhetorically, stressing that the law does not compel the impossible. He said neither Fintri nor Ngilari deserved to be the beneficiary of Nyako’s impeachment.
‘’Until we lawyers begin to sanitize the legal system, the politicians will continue to pollute the system for us all’’, he said.
Agbaje however, admonished the Federal Government to desist from selective implementation of court judgments. He said the Federal Government quickly rushed to town with the directive that Ngilari be sworn in all because he never defected to APC along with Nyako, adding that the presidency knew that head or tail, the State would remain under the control of PDP with Ngilari as Governor.
Meanwhile, House Chairman on Information in Adamawa State, Adamu Kamale, today disclosed that the Speaker has gone back to court to appeal the judgment of the lower court that installed Ngilari as Governor.
Kamale said Ngilari actually resigned. He said the new Governor wrote three letters; one for the former Governor, one for the Speaker. He said upon receipt of the letter of resignation by Nyako, the former Governor made a recommendation for a replacement for Ngilari to the Speaker.
He disclosed that he (Kamale) was actually nominated by the former Governor to replaced Ngilari who purportedly resigned. He said the Speaker who had resumed at his desk as Speaker had gone back to the upper court for redress.
