The Rivers State Governorship Election Petitions Tribunal sitting in Abuja on Friday refused an application brought by the All Progressives Congress (APC) governorship candidate, Dr Dakuku Peterside and his party, seeking to compel the Independent National Electoral Commission (INEC) to allow the them scan and photocopy the election materials used during the April 11 governorship election in the state.
Peterside and APC had brought the application in the petition they filed before the tribunal challenging Governor Wike’s election on the ground that the election was marred by malpractices.
They had at the last sitting urged the tribunal to make an order directing INEC to avail them the materials used to conduct the elections to enable them scan them and make photocopies.
Delivering ruling on the application, the tribunal chairman, Justice Muazu Pindiga, held that the application was an abuse of court process.
The tribunal had previously refused an application by the applicants for an order directing INEC to move the election materials used for the governorship election to Abuja for inspection.
“The application seeking an order for the scanning of electoral materials used to conduct the governorship election in Rivers is, hereby, refused.
“The order of June 11 still subsists and hearing is, hereby, fixed for September 3,” Pindiga said.
Following the ruling, Mr Akin Olujimi, SAN, counsel to the applicants informed the tribunal that he had 200 witnesses to tender evidence before the tribunal at the hearing proper.
Pindiga adjourned sitting till September 3, for proper hearing of the tribunal and taking of witnesses.
