A Makurdi Magistrates’ Court on Wednesday ordered Terkimbi Mbabou, charged with killing one Luke Anyanwu during a fight, to be remanded in the Makurdi prison custody.
The Magistrate, Mrs Lillian Tsumba, gave the order following the arraignment of the accused, who could not take his plea for want of jurisdiction when the case came up for hearing.
Mbabou, 49, and native of Agedam Community in Gboko West Local Government Area, was charged with culpable homicide punishable under Section 225 of the Penal Code Laws of Benue State, 2004.
At Wednesday’s arraignment, the prosecuting police officer, Inspector Terzungwe Kajo, said that the accused, on Aug. 29, kicked the deceased on the face during a fight and blood started gushing out of his mouth.
The prosecutor said the wife of the deceased, Mrs Theresa Anyanwu, had reported the incident at the police station on Sept. 1.
He said the nominal complainant had explained that her husband was rushed to the General Hospital, Gboko but died while receiving treatment.
Kajo submitted that the accused, who ran away after committing the crime, was later arrested in the course of police investigation.
He stressed that the case was transferred from ‘A’ Division Police Headquarters, Gboko to the Criminal Investigation and Intelligence Department, Makurdi for investigation.
The Magistrate adjourned the case until October 28, for hearing of preliminary arguments on jurisdiction.
