The Court of Appeal in Yola on Tuesday affirmed the sacking of Senator Bashir Marafa of the Peoples Democratic Party, PDP, Taraba Central Senatorial District and ordered the Independent National Electoral Commission, INEC to issue Certificate of Return to the All Progressives Congress candidate, APC, Yusuf Abubakar, as the duly elected Senator.
The Street Journal recalls that the National Assembly Election Petitions Tribunal had on September 30, nullified the election of Marafa and ordered the the recognition of Abubakar as the winner of the Taraba Central Senatorial election.
Marafa had, therefore, approached the Court of Appeal to reverse the decision of the tribunal.
Delivering judgment, the three-man panel of the appellate court unanimously held that the appeal lacked merit and dismissed it accordingly.
The court also held that Abubakar and his party, the APC, had proved their case beyond reasonable doubt, and Marafa did not score the lawful majority votes in the March 28 polls.
It, therefore, ordered the Independent National Electoral Commission, INEC, to return Mr. Abubakar as the candidate that scored the majority lawful votes during the polls.
It would be recalled that the tribunal had earlier nullified the election of another PDP Senator from the state, Alhaji Sani Danladi, on the grounds of electoral malpractice and breach of the provisions of the Electoral Act 2010, as amended.
