ECOWAS Court Adjourns Till Feb. 9 for Ruling on Kanu’s Bail Application

The ECOWAS court has defered ruling on the bail application brought before it by the leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, till February 9, 2017.
The three-man panel of Justices made up of Justice Micha Wilkins, Justice Yaya Boiro, and Justice Akiaine Sallm said on Tuesday by that date they would have arrived at a judgment based on international law.
Earlier, counsel to Kanu, Barrister Ejiofor stated that he received a surprising application on Monday on why Kanu should not be granted bail.
According to him, the Federal Government brought the motion to stop ECOWAS Court from entertaining the suit because the matter is before a Federal High Court in Abuja.
But Ejiofor prayed the court to discountenance the application, insisting that it is a delay tactics to stop the honourable court from hearing the case.
His arguments were based on Article 35 of the ECOWAS court which ruled against such application.
He further stated that the plaintiffs’ rights have been grossly violated by the Nigerian government , he therefor urged the court to dismiss the new application against the defendant, “because any application coming after the adjourned date should be for extension and not for leave of court”
He also narrated the ordeal of the plaintiffs beginning from Oct 14, 2015 when he was apprehended and the sequence of events that have transpired in courts in regards to his bail, its condition fulfilment, and abject refusal of the Nigerian government in releasing the plaintiffs which was evidenced by the presidential media chat of Dec 30, 2015.
Responding to the Ejiofor’s argument, counsel to the Federal Government of Nigeria told the court that two Municipal courts (The High Court and the Appeal Court) refused to grant the plaintiffs bail, and as such should not be granted bail.
He stated more that while waiting for the judgment of the Appeal Court the plaintiffs “ran” to the ECOWAS court.
After listening to the arguments, Justice Micha adjourned the case till Feb 9, 2017.
