Court Sacks Senator, Orders Him to Refund Emoluments

A Senator representing representing Akwa Ibom North-East Senatorial district, Bassey Akpan, was Monday, sacked from the Nigerian Senate and asked to refund the emoluments he has received so far.
A Federal High Court in Uyo, Akwa Ibom State capital, gave the judgment in Uyo, Monday, in a case between Bassey Etim (known as BAFIL) and Akpan both of Peoples Democratic Party (PDP) .
Etim had dragged Akpan, who is a former Commissioner for Finance during the administration of Godswill Akpabio, and currently the Chairman, Senate Committee on Gas, to court, seeking the court’s nullification the presentation of Akpan as the authentic candidate of PDP, in the 2015 senatorial election in the state.
In a judgment, the court said Akpan vied for the PDP governorship ticket in the state, and not for the party’s senate ticket.
The court ruled that the Independent National Electoral Commission (INEC), should immediately issue a certificate of return to Etim, a former member of the Federal House of Representatives, and that the Senate should swear him in as the Senator representing the district.
The court held that it was tantamount to illegality and depravity of Etim’s rights as he was the rightful candidate of the party.
The court thus gave Akpan 90 days to refund all the money he has received as emoluments so far from the National Assembly.
