How Yobe State Sharia Court Chief Judge Altered His Birth Certificate To Avoid Retirement

The North-East zonal office of the Movement for Justice in Nigeria (MOJIN) has written to the Chief Judge of Nigeria, Justice Mohammed Tanko on the alleged falsification of age by the Yobe State Grand Kadi of the Sharia Court of Appeal, Shu’aibu Talba.

In the letter signed by Mallam Zakari Adamu, addressed to Justice Mohammed Tanko, dated July 20, 2020, and exclusively sighted by The Street Journal, it was alleged that the grand Kadi of Yobe State adjusted his date of birth twice with the aim of extending his years of active service, which generally is against the Civil Service rules of Yobe State.

According to the civil service laws in Nigeria, it is mandatory for civil servants to retire after 35 years in active service.

The real date of birth of the Grand Kadi, according to the petitioners, is 1st February 1955. which he had written in the National Judicial Council (NJC) Nominal Roll Of Judicial Officers 2009 Budget proposal, making his retirement date effective 1st February 2020.

However, the Grand Kadi’s date of birth was adjusted to 30th December 1959 as contained in the NJC Nominal roll Of Judicial Officers 2020 Budget proposal.

The letter read in part:

“My lordship, our first observation proved to us that, his (Grand Kadi) actual and official date of birth in the Yobe State Civil Service as aforementioned in the National Judicial Council (N.J.C) Nominal Roll of Judicial Officers 2009 Budget Proposal was 01st/02/1955 which the retirement date should be o1st/02/2020, but, an alteration was made to 27th/08/1955 and the retirement date remains 01st/02/2020. And his (Grand Kadi) date of birth was further amended to 30th/12/1959, as contained in the National Judicial Judges nominal Rolls for 2020 Budget proposal.”

The MOJIN, therefore, urged the Chief Justice to intervene because, from all indication, the Grand Kadi has illegally benefitted six months allowance from the Yobe State Government after failing to retire in February this year.

The Sharia law court was introduced in Nigeria, precisely Zamfara State in 1999; and are known to issue grave sentences for even the smallest crimes.

The letter reads:

COMPLAINT OF FALSIFICATION OF DATE OF BIRTH (D.O.B) BY THE YOBE STATE GRAND KADI

The Movement for Justice in Nigeria North-East Zone wishes to write and forward a complaint of the above subject.

My lordship, it was discovered that the Grand Kadi in Yobe State falsified his date of birth where he has adjusted his date of birth three times to gain long term in service which is against the Civil Service rules of Yobe State and that of the country as a whole.

My lordship, our first observation proved to us that his actual and official date of birth in the Yobe State Civil Service as aforementioned in the National Judicial Council nominal roll of judicial officers 2009 budget proposal was 01/02/1955 which the retirement date should be 01/02/2020 but an alteration was made to 27/08/1955 and the retirement date remains 01/02/2020.

And his (Grand Kadi) date of birth was further amended to 30/12/1959 as contained in the National Judicial Council Nominal Rolls for 2020 budget proposal. 

In view of the above therefore, his retirement should have taken effect since 01/02/2020. As such, six months are now added to his years of service which is not in line with the Yobe State Civil Service rules.

Your lordship, the Organization solicits for your help to please advise the Grand Kadi of Yobe State to retire from service immediately so as to allow the entitled officer to take over.

This organization does not want to revealed any secret of anybody but our main aim is the prevalence of Justice.

Your lordship, we anticipate your usual cooperation, please.

The MOJIN, together with the letter, attached the National Judicial Council Nominal Rolls for 2020 budget proposal, which gave an insight into the monthly allowance of the Grand Kadi and Kadi.
